WeFilm User Consent & Authorization

1. The service

Using your theme description and up to 2 characters (each with a name, an introduction and one photo), we use AI to create a video: an AI Short Drama of about 5 minutes or an AI Music Video of about 3 minutes.

AI-generated content involves randomness and artistic interpretation. The appearance, expressions, movements and scenes in the final video may differ from the people in the photos or from your description; this does not constitute a defect.

2. Age requirement

You confirm that you are at least 18 years old and have full legal capacity, and that everyone in the photos you upload is at least 18. We do not provide the service to minors and do not accept photos that include minors.

3. Photos and likeness license

Each character needs one photo. The person in each photo must be you, or an adult who has explicitly agreed to let you use their photo and likeness for this order (for example your partner, a family member or a friend). You must not upload photos of celebrities or public figures, images taken from the internet, or photos of other people without their consent.

If you upload a photo of someone else, you warrant that you have told them how the photo will be used, processed and kept, and that you have their explicit consent to that processing. You must provide proof of that consent if we ask. If we have reason to believe consent was not given, we may decline the order and refund it in full.

You grant us (and warrant that everyone else in the photos has agreed to grant us) a limited, non-exclusive, non-transferable license to use, copy and process the photos, likenesses and any digital likeness derived from them, solely to produce and deliver the video you ordered.

Without separate written consent, we will not use the photos or videos to train AI models, for advertising, for portfolio display, or for any other purpose.

4. Facial data and other sensitive personal information

Facial images and their features are sensitive personal information. You explicitly consent (and warrant that everyone else in the photos has explicitly consented) to our processing of the facial data in the photos for the purpose of producing your video.

To produce the video, we may use third-party AI generation services to process your photos. We share only what is necessary to produce your video and require that the data is not used for any other purpose.

Photos are accessible only to our production staff and are stored behind login-protected access.

5. Content rules

Your theme and character introductions must not include: sexual or vulgar content, graphic violence, illegal activity, discrimination or hate, insulting, defaming or demeaning the people in the photos or anyone else, impersonating other people or public figures, infringing others' intellectual property (e.g. requesting copyrighted original songs or film characters), or anything else that violates applicable law.

If a theme or character does not meet these rules, we may decline to produce it or make reasonable adjustments. Declined orders are fully refunded.

6. Delivery and your Google account

The finished video is uploaded to Google Drive and shared with the Google account you provide when ordering. You agree that we may use that email address for delivery.

Please make sure the Google account is correct and belongs to you. Delays caused by an incorrect account are your responsibility, though we will help you correct it.

Please download your video within 30 days of receiving the link; after that the shared link may stop working.

7. Using the finished video

The finished video is for your personal, non-commercial use. Contact us separately for commercial use.

The video is AI-generated (synthetic) content. When publishing or sharing it publicly, you must label it as AI-generated where applicable law requires, and you must not use it to impersonate anyone, mislead the public, commit fraud or engage in any other unlawful activity.

If the video shows anyone other than you, you must also get their consent before publishing or sharing it publicly.

8. Data retention and deletion

Your uploaded photos and theme are kept for 30 days after the order is completed, to handle any issues, and are then deleted.

You may contact us at any time to request earlier deletion of your photos or order data, or to close your account. Account information is kept while your account exists.

9. Website analytics

To understand how the site is used and improve it, we record visit statistics: which pages are viewed, how visitors arrive (for example from a search engine, a social platform or a campaign link), device type (phone, tablet or computer) and language, and whether steps such as signing up, ordering and paying are completed.

This uses no cookies and does not record IP addresses. We store a randomly generated visitor ID in your browser’s local storage to tell visitors apart; it contains no name, email or other personal details. After you sign up or order, the related statistics are linked to your account and orders.

This data is used only for our internal analysis of the site and service. It is not sold, not used for advertising and not shared with third parties. You can delete the visitor ID at any time by clearing your browser’s local storage, or contact us to delete statistics linked to your account.

10. Payment and refunds

Once paid, an order is scheduled for production. You may request a full refund before we start production.

Once production has started, orders are generally non-refundable because AI generation consumes compute and staff time. If we are unable to deliver, you will receive a full refund.

11. Withdrawing consent

You may withdraw this consent at any time. We will then stop processing and delete your photos and facial data; orders not yet in production will be cancelled and refunded, and orders already in production may not be completed.

Anyone else in your photos may also contact us at any time to withdraw their consent; we will delete their photo and handle the order as described above.

Withdrawal does not affect the lawfulness of processing carried out based on consent before the withdrawal.

12. Limitation of liability

To the extent permitted by law, we make no guarantee as to the artistic result of AI-generated content. You are responsible for any disputes or losses arising from your breach of this consent (for example, uploading someone else's photo without their consent or submitting a prohibited theme), and you will compensate us or the people in the photos for any resulting loss.

13. Changes and contact

We may update this consent from time to time. Material changes will be announced on the website and, where required, we will ask for your consent again.
